Incumbent Marvin G. Dilks Jr. could still challenge the outcome after a re-count yields another tie vote.

MONROE TWP. -- A recount of the ballots cast in a contested Democratic municipal primary race has yielded the same outcome -- a tie vote.

Incumbent Marvin G. Dilks Jr. and Richard Coe received 478 votes each in the June 7 primary race for a Ward 1 council seat.

Following that outcome, the executive committee of the township's Democratic Party broke the tie by selecting Coe, who previously served on council, as their candidate.

Dilks filed for a recount and that process took place Monday morning.

The candidates now have a 10-day period in which they can file a petition contesting the outcome, explained Dilks' attorney, Brett Pugach.

A candidate could file a challenge on various grounds, Pugach said, offering examples such as voters casting ballots when they are not eligible to do so or voters being improperly excluded from casting a ballot.

Dilks is reviewing his options, Pugach said Monday afternoon, but declined to elaborate on whether he will file a petition or what grounds he may have for challenging the vote tally.

"I don't know that I can really get into it," Pugach said. "It's something that is definitely being considered, based on information that we have."

The winner of the Democratic primary will face Republican William Blong in November.
